If you’re accused of any crime whatsoever, chances are it may be a good idea to get a criminal defense attorney. But most people don’t even know where to begin. So this article will give you the best idea of what the process is to give you knowledge the need should you ever find yourself in a position of trial or legal allegations.

Most of the time, you’ll want a criminal defense attorney when your arrested. So what exactly happens when you get arrested? Well the entire process will vary from state-to-state respectively, but in general…any law enforcement officers involved in the situation will start by creating a police report. This report will be composed of various witness statements, background check and more. After this an officer will take this information or report to a criminal prosecutor, who will check the documents and ultimately figure out whether or not the crimes or charges are properly warranted. Sometimes cases can be rejected—if they are not, they will be filed. After this, the defendant will be arrested—it is during this time, before the trial you can be let out of jail by paying bail. Bail amounts are often times VERY high, but its important to note you receive your bail amount back when you return to court. Think of bail as kind of an insurance that you’ll be coming to your trial. Collateral essentially to make sure you’re present. This doesn’t apply to juveniles, as when they are arrested—they will be grouped into one of two categories: detained or not detained. So a juvenile who is detained, cannot be released on bail—their fate will rest in the trial.

Another important thing to note about allegations is that even if the plaintiff chooses to drop charges—you may not be in the clear, as the prosecution can still choose to take you to trial if they feel they have enough evidence to make a case against you. Once again, this is general—and a criminal defense lawyer will be able to help you through this situation should you find yourself in it.

Cost is one of the most often and common excuses for people not having a lawyer, but in reality its not really an excuse at all. You have a wide array of options. Most lawyers can arrange a wide variety of payment plans and large law firms can even finance you in certain cases.
